DISTANCE SALES CONTRACT

Article 1: Parties

BUYER: Customer

Article 2: Subject of the Contract

This Distance Sales Contract regulates the rights and obligations of the parties in accordance with the Consumer Protection Law No. 6502 and the Distance Contracts Regulation, regarding the sale and delivery of the product(s) specified below, which the BUYER has ordered electronically from the SELLER’s website mismimi.com.

Article 3: Product Information

The type, quantity, brand/model, sales price, payment method, and other details of the ordered product(s) are as follows:

Article 4: Delivery Information

Delivery will be made to the BUYER’s delivery address via a courier company, to the authorized person(s) specified during the order. The SELLER is not responsible for delays due to incorrect information, wrong addresses, or the BUYER not being present at the delivery location.

Delivery Conditions: The product will be shipped within a maximum of 14 days, depending on stock availability.
Shipping Fee: Unless otherwise stated, the shipping cost is added to the order and paid by the BUYER. It is not covered by the SELLER.

Article 5: Payment Terms

The BUYER shall pay for the ordered product using one of the following methods: credit card, bank transfer, or cash on delivery. The order will begin processing only after the payment has been completed.

Any issues related to payment transactions are between the BUYER and the payment service provider, and the SELLER cannot be held responsible for such issues.

Article 6: Right of Withdrawal

The BUYER has the right to withdraw from the contract within 14 (fourteen) days from the delivery of the product to them or the person/entity at the designated address, without giving any reason and without incurring any legal or penal liability. The withdrawal period begins on the day the BUYER receives the product.

Valid conditions for using the right of withdrawal:

Products must be returned unused, untried, undamaged, with original packaging intact, and in a condition suitable for resale.

Cases where the right of withdrawal does NOT apply:

Products prepared in accordance with the BUYER’s personal requests or clearly personal needs,
Opened hygiene and health-related products (cosmetics, underwear, etc.).

When exercising the right of withdrawal:

The BUYER must notify the SELLER of their intention to withdraw via a clear written statement or e-mail.
Products returned under the right of withdrawal must be sent using the SELLER’s contracted courier company.
The product price will be refunded to the BUYER, using the original payment method, within a maximum of 14 days after the returned product reaches the SELLER.

Article 7: Return and Exchange Conditions

If the BUYER detects any damage, defect, or fault in the product upon delivery, they may request a return or exchange within 14 days from the day they receive the product. The BUYER must submit their claim with photo or video documentation showing the defect.

Article 8: Responsibilities

The SELLER is responsible for delivering the ordered products in accordance with the specifications in the contract, in a complete and fault-free manner.
The BUYER agrees that the information provided during the order is accurate and that they or an authorized person will be present at the delivery address. If the BUYER is not present, any additional delivery costs will be borne by the BUYER.

Article 9: Legal Regulations

This contract is governed by the laws of the Republic of Türkiye. For any disputes arising from this contract, Consumer Arbitration Boards and Consumer Courts shall have jurisdiction.

Article 10: Enforcement

This contract enters into force upon electronic approval by the BUYER and becomes valid upon acceptance of the order by the SELLER.
